Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Jeremiah Norman Liverseidge, doing business as Zestt ("Zestt," "I," "me," or "my"), and govern your use of the Zestt Kitchen app, website pages, and related services.

1. Acceptance of Terms

By accessing or using the service, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the service.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction (if higher), to use the service.

3. Service Description

Zestt provides pantry management, receipt OCR, voice logging, deterministic recipe matching, grocery-list support, and related tools. Features may change and may vary by region, rollout phase, and technical availability.

5. License to Use the Service

Subject to these Terms, Zestt grants you a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use of the service.

6. User Content and Processing License

You are responsible for content you provide (for example images, voice input, pantry entries, mappings, and URLs) and represent that you have the rights needed to provide it.

You grant Zestt a limited, non-exclusive, revocable license to process such content solely as necessary to operate, secure, and improve the service in accordance with the Privacy Policy.

7. Regional Availability and Capability Packs

The service may use market-based capability profiles and signed data packs. Some regions may operate in reduced/manual-first mode if required packs are unavailable, incompatible, disabled, or fail quality/compliance checks.

8. Acceptable Use

You agree not to: (a) misuse or interfere with service operation; (b) bypass access controls or billing restrictions; (c) reverse engineer except where legally permitted; or (d) use the service in violation of applicable law.

9. Data and Deletion

Data handling is described in the Privacy Policy. You may request deletion where applicable and may delete local data using in-app tools, app storage clear, uninstall, or the official delete-account workflow.

10. Third-Party Services

Certain functionality depends on third-party platforms (including app stores and optional device-level speech services). Their terms and policies apply to their services.

11. Allergy and Safety Disclaimer

The service is not medical, nutritional, or professional dietary advice. You are solely responsible for verifying allergens, intolerances, ingredient quantities, substitutions, and cooking safety.

12. Intellectual Property

The service, software, branding, and related materials are owned by Zestt and licensors, except for third-party or user-provided content.

13. Disclaimer of Warranties

To the maximum extent permitted by law, the service is provided "as is" and "as available," without warranties of any kind, express or implied.

14. Limitation of Liability

To the maximum extent permitted by law, Zestt will not be liable for indirect, incidental, consequential, special, or punitive damages, or loss of data/profits/revenue. To the extent liability cannot be excluded, Zestt's aggregate liability is limited to the greater of (a) amounts you paid for the service in the prior 12 months, or (b) USD $50.

15. Indemnification

You agree to defend, indemnify, and hold harmless Zestt from claims, liabilities, losses, and expenses arising from your use of the service, your content, or your violation of these Terms, to the extent permitted by law.

16. Termination

Zestt may suspend or terminate access for violation of these Terms or for security/compliance reasons. You may stop using the service at any time.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Tennessee, USA, without regard to conflict-of-law rules. Subject to mandatory consumer protections in your jurisdiction, disputes shall be resolved in competent courts located in Tennessee.

18. Severability, Waiver, Assignment

If any provision is held invalid or unenforceable, the remaining provisions remain in effect. Failure to enforce any provision is not a waiver. You may not assign these Terms without prior written consent; Zestt may assign them in connection with merger, acquisition, or asset transfer.

19. Changes to Terms

Zestt may update these Terms. Continued use after the updated effective date constitutes acceptance of the revised Terms.
